The principle of mediation was found for the first time by the courts to take precedence over the setting down of a summary trial. In this case, the court denied the application to postpone a mediation until after a summary trial in order to allow the parties an opportunity to resolve the litigation by mediation before resorting to the adversarial setting of summary trial.
