Tsawwassen Asset Division Lawyers

Asset Division

At our firm, our family lawyers have experience in dividing assets during the divorce process. We work to ensure that you receive what you are rightfully owed. Dividing property can be a complex process, but by thoroughly evaluating what each party owns individually and jointly, we can work towards a fair outcome. In Tsawwassen, British Columbia it is especially important to consider the historical value of pre-owned property when determining the distribution of assets following a separation.

Divorce in Tsawwassen

If you need to obtain a divorce order as part of your family law case in Tsawwassen, we can assist you. Instead, there may be more pressing concerns that require immediate attention, such as financial security and arrangements for any children involved. If a divorce order is needed, we can help you navigate the process.

Child support lawyers in Tsawwassen

Child Support

Our Tsawwassen Family Law and child support lawyers can help you protect your child’s right to adequate financial support. It is widely accepted that children are entitled to have the financial resources of both parents available to support them as they grow and develop. While there are many online resources that can provide an estimate of the basic monthly child support obligation under the Federal Child Support Guidelines, our lawyers can help you navigate the process and ensure that your child’s rights are protected.

Spousal Support

With a wealth of experience in Spousal Support Advisory Guidelines, we can provide clear, easy-to-understand advice about how spousal support will affect your life after separation. Our team is dedicated to helping you navigate this complex area of law and achieve a favourable outcome for your situation.

Co-Parenting Responsibilities

We are dedicated to safeguarding children from the harmful consequences of divorce and will collaborate with child experts, physicians, and therapists to ensure that your perspective and your child’s perspective are considered during this highly emotional process.

Premarital and Cohabitation Agreements

Our Tsawwassen lawyers can help you determine if a premarital or cohabitation agreement is the right choice for you. These agreements are useful for outlining financial expectations in the event of unforeseen circumstances, such as separation or divorce. Every couple has different needs, so it’s worth considering the benefits of having a written agreement in place. Rather than asking “do I need an agreement?”, you may want to consider “why wouldn’t I have an agreement?”

Tsawwassen family law, served from New Westminster

Tsawwassen sits at Delta’s southwest corner, near the ferry terminal and Boundary Bay, about 35 minutes from our New Westminster office at 26 Fourth Street by Highway 17 and Highway 91. Onyx Law Group has no Delta office, so we work with Tsawwassen clients from New Westminster or by video, which tends to suit people who don’t want the drive in addition to everything else.

Delta has no Supreme Court registry, so Tsawwassen family files are generally opened at the New Westminster Supreme Court registry. Property division under the Family Law Act follows a clear default: spouses share family property and family debt equally, regardless of whose name is on the title or the account. Property one spouse brought into the relationship, or received as a gift or inheritance during it, is usually excluded, though the growth in its value while the couple was together is normally shared. The Act treats married spouses and unmarried couples who lived together at least two years the same way on this.
