Estates, Trusts and Probate

How to get a comprehensive estate plan in place that achieves your goals, provides for your loved ones, and protects against legal challenges.
Planning for the possibility of future incapacity. If you have an Enduring Power of Attorney and a Representation Agreement in place, the person (or people) of your choice can make decisions on your behalf. See here for more on substitute decision makers, advanced directives, and making a living will BC).
Creating trusts to benefit yourself, your spouse, your children and/or others. For example, you may want advice on whether an alter ego trust, joint partner trust, or family trust is right in your situation (see here for more on how family trusts work and here for the costs of a family trust Canada, you may want advice on how to structure a disability trust, or you may be considering the pros and cons of putting property such as your home into trust during your lifetime (see this article for more on living trust Canada).
Determining whether probate is necessary after the death of a loved one.
What to do after a family member dies without a will (see here for more on intestacy, appointment of an estate administrator, and the detailed succession rules set out in the Wills, Estates and Succession Act, SBC 2009, c. 13, known as “WESA”).
What are the steps in the probate process and how long does probate take in BC?
What happens after probate is granted in BC, and what are the estate executor’s responsibilities following issuance of the estate grant?
Deciding if you should contest a loved one’s will. What are the legal grounds, what are the possible outcomes, and what are the odds of winning contesting a will in BC?
Options for addressing disinheritance, unequal treatment, or inadequate provision after the death of a parent or spouse. For example, an estranged daughter left out of a will can bring a wills variation claim under WESA s. 60.
What to do if you believe you have an unclaimed inheritance (the Onyx team prepared this article on unclaimed inheritance Canada, which may be helpful).

Divorce and Family Law

Preparing a fair, enforceable prenuptial agreement, cohabitation agreement, or marriage contract that crystallizes your future rights and obligations. These types of written agreements are particularly valuable for high-net-worth individuals and spouses entering subsequent marriages.
Ways to protect yourself, your income, your children, and your property in the event of separation or divorce, whether the situation is amicable or high conflict.
How to navigate the legal process when filing for divorce in BC.
Exploring options for resolving family law issues outside of court, such as negotiation, mediation, arbitration, and collaborative family law.
Claiming or enforcing child support and spousal support obligations.
Understanding rights and obligations when you are living common law in BC and exploring how to protect your income and property with a cohabitation agreement.
How to navigate co-parenting and create a parenting plan following separation or divorce.
Determining how assets and debt are divided on separation or divorce (this will depend on several factors, including whether you have a prenuptial agreement or marriage contract in place that ousts the operation of the default property regime in the Family Law Act).
At Onyx Law Group, we represent clients who are facing a broad range of legal concerns. Our lawyers are able to assist you in even the most high-conflict or complex family, estate, and trust law matters.

Proven Track Record

We have a thoroughly established reputation for providing exceptional legal representation and personalized service to our clients. Some of our notable results include:

Sangha v. Sangha: Onyx Law Group’s Vancouver estate lawyers represented the executor of an estate in successfully claiming for relief on the basis of unjust enrichment, resulting in a judgment in the amount of $400,000 in favour of the estate.

Hancock v. Hancock: Substantial variation awarded to disinherited children who were represented by Onyx lawyers in this wills variation action. Significant gifts given to children who had good relationships with the testator before the testator’s death were found not to be a valid reason to exclude those children from the testator’s Last Will and Testament.

R.P. Johnson Family Trust (Trustees of) v. Johnson: Onyx counsel represented parties in securing much-needed assistance from the court in determining which family members qualify as beneficiaries of a trust. The court’s notable decision in this matter has been relied on in other cases involving the interpretation of wills and trusts.

Sevy v. Sevy: Family dispute over the manner in which trustees administered a trust and dealt with the trust’s assets. Certain property transfers executed by the trustee were found to be breaches of trust. The court ordered the property restored to the trust, removed two trustees, and appointed an independent trustee to act in the interest of all beneficiaries, including Onyx’s client.

Volovsek v. Boisvenu Alter‐Ego Trust #1: Successful appeal reducing damages for trespass from $100,000 to nominal damages of $2,500 in a case involving disputed possession of a Vancouver condominium after the death of its owner. The long-time partner of the deceased condo owner was represented on appeal by Candace Cho in this estate litigation matter.

A.S.N. v K.E.K: Notable and oft-cited case in which Onyx’s Judith Janzen advocated for the mother of a four‑and‑a‑half-year‑old child in a vaccination dispute. The father of the child wanted sole decision-making authority with respect to medical treatments, including vaccines. The court concluded that it was in the child’s best interests to receive vaccinations as recommended by the public health system.

Whether you need help navigating estate litigation, a family law dispute, or the probate process, or you need guidance with estate planning, our team is here to guide you through the legal process and protect your rights and interests. We are committed to achieving the best possible outcomes in every legal situation we handle.

Past results are not indicative of future outcomes; every case turns on its own facts.
