How Much Does an Executor Get Paid in BC?

Onyx Law Group · Vancouver, British Columbia

Family members often act for free, but in BC an executor can claim up to 5% of the estate’s value. Trust companies and law firms set their fees by agreement, usually a percentage based on the size and complexity of the estate, and those fees can be negotiated. A will can also set the pay as a percentage or a flat fee.

How much does an executor get paid in BC and what does a professional executor charge? Well, often times when family members act as an executor, they often don’t charge a fee. But they can charge a fee up to 5%. And what happens with corporate executors or law firms that charge to do this work is they come up with a fee agreement and it’s like a contract and the fees will depend on how large the estate is, and the fees are going to be a percentage of the value of the estate and they’ll charge anywhere I’m going to guess between two and five percent depending on the complexity of the estate but it is something that you can research and reach out to trust companies and find out and get their fee agreement and review it and you can even negotiate their fees with family members very rarely does a will outline how much an executor gets paid you can set the payment amount in your will.

It could be a percentage and it can also be a flat fee. One time I drafted a will and the compensation was a case of beer. So the compensation is completely negotiable and you, if you’ve been named as an executor and you don’t like the compensation, you can always refuse and renunciate.
