Will an inheritance cut off my child’s government disability assistance? That depends on how large the inheritance is. Your child is inheriting $200,000 or less, then it should not affect their government disability assistance at all. If the inheritance is larger, in order to prevent anything happening to their payments, then we recommend that the family set up a disability trust and appoint a trustee to oversee, administer, take care of those assets because those assets will now be in the name of the trust and not in the name of the person with the disabilities. And then the government benefits should continue.
